Boat Rental Agreement & Release

Please read the following sections fully and carefully before signing. This is a legally valid and binding agreement that releases the Company from all known and unknown obligations and indemnifies the Company against claims arising from your use of the boat. This document affects important legal rights.

Appeldoorn's Resort Watercraft Liability Waiver

This Watercraft Liability Waiver (the "Waiver") is executed on the date mentioned above by the undersigned (the "Renter") in favor of Appeldoorn's Sunset Bay Resort (the "Resort"), located in Isle, MN.

1. Acknowledgment of Risks: The Renter acknowledges and understands that operating and renting a watercraft involves inherent risks including but not limited to risks of injury, death, and property damage. The Renter voluntarily assumes all risks associated with the operation and use of the watercraft.
2. Waiver and Release: In consideration of being allowed to rent and operate a watercraft from the Resort, the Renter, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby waives, releases, and discharges the Resort, its owners, employees, agents, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to the Renters use of the watercraft, including but not limited to any injury, death, or property damage.
3. Responsibility for Damages: The Renter agrees to be financially responsible for any and all damages to the watercraft and any associated equipment that occur during the rental period. The Renter authorizes the Resort to charge the credit card on file for any repair or replacements necessary, due to such damages.
4. Compliance with Laws and Regulations: The Renter agrees to comply with all local, state, and federal laws and regulations while operating the watercraft. The Renter acknowledges that failure to comply with these laws and regulations may result in fines and penalties or other legal consequences for which the Renter will be solely responsible.
5. Indemnification: The Renter agrees to indemnify, defend, and hold harmless the Resort, its owners, employees, agents and affiliates from and against any and all claims, liabilities, damages, or causes of action brought by third parties arising out of or related to the Renters use of the watercraft.
6. Condition of Watercraft: The Renter will be instructed by Appeldoorn's Staff on the use of the watercraft and conduct a joint inspection of the watercraft prior to the guest's use. The Renter agrees to return the watercraft in the same condition in which it was received. Pictures will be taken prior to and after the rental of the watercraft to document any changes in the condition of the watercraft. Renter understands and agrees they are responsible for any damage that may occur during their use of the watercraft.
7. Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the State of Minnesota. Any legal action or proceeding arising out of or related to this Waiver shall be brought exclusively in the courts of the State of Minnesota.
8. Entire Agreement: This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements or understandings, whether written or oral.
9. Severability: If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Acknowledgment of Understanding: The Renter acknowledges that they have read this Waiver, understand its terms and agree to be bound by them. The Renter further acknowledges that they are signing this Waiver freely and voluntarily with full knowledge of its legal significance.
11. Minimum Age and Operational Restrictions: The Renter acknowledges that the minimum age to rent and operate the watercraft is 21 years old. Additionally the watercraft must be returned to the Resort by 6:45pm local time. Failure to comply will result in a fine of $200.00
12. Prohibited Activities: The Renter agrees that activities such as tubing, water skiing, or any similar activities are strictly prohibited while using the watercraft rented from the Resort.

By signing this Waiver, the Renter agrees to all terms and conditions set forth herein.

Disclaimer of Liability for Boat Launching

At Appeldoorn's Sunset Bay Resort, we are committed to providing a safe and enjoyable experience for all our guests. As part of our services, we offer the use of our tractor to assist with launching boats. Please read the following disclaimer carefully before utilizing this service.

1. Acknowledgment of Risk: By requesting the use of our tractor for launching your boat, you acknowledge and accept the inherent risks involved in the process. These risks may include, but are not limited to, potential damage to the boat, trailer, or associated equipment.
2. Release of Liability: Appeldoorn's Sunset Bay Resort, its employees, agents, and contractors shall not be held liable for any damage or loss incurred to your boat, trailer, or any other personal property during the launch process. This includes, but is not limited to, any incidental or consequential damages resulting from mechanical failure, human error, or unforeseen circumstances.
3. Insurance Coverage: We recommend that you verify your own insurance coverage to ensure that it adequately protects against any potential damage or loss that may occur. Our resort's insurance policy does not cover personal property or boats during the launch process.
4. Indemnification: You agree to indemnify and hold harmless Appeldoorn's Sunset Bay Resort, its employees, agents, and contractors from any claims, demands, or legal actions arising out of or related to the boat launching service provided.
5. Conditions of Service: Our tractor and equipment are maintained to the highest standards; however, we cannot guarantee against all potential issues. Please ensure that your boat and trailer are in proper condition for launching and that you provide accurate and clear instructions for the process.

By using our boat launching service, you confirm that you have read, understood, and agreed to the terms of this disclaimer.
I hereby agree to pay Appeldoorn's Sunset Bay Resort $20 for launching my boat or $30 for launching and loading.
